A BILL to amend and reenact §22-15A-16 of the Code of West
Virginia, 1931, as amended, relating to setting recycling
goals; conducting a one-time study to determine the recycling
rate in West Virginia; requiring the submission of recycling
data; and initiating a one-time award program to recognize
certain recycling leaders.
Be it enacted by the Legislature of West Virginia:
That §22-15A-16 of the Code of West Virginia, 1931, as
amended, be amended and reenacted to read as follows:
ARTICLE 15A. THE A. JAMES MANCHIN REHABILITATION ENVIRONMENTAL
ACTION PLAN.
§22-15A-16. Recycling goals.
(a) By January 1,
two thousand ten 2014, it is the goal of
this state to
reduce the disposal of municipal solid waste by recycle fifty percent of the amount of
per capita solid waste
generated.

(b) In an effort to determine the status of the recycling
goals, the West Virginia Solid Waste Management Board shall conduct
a one-time study to determine the recycling rate of each county and
the state. The study shall be conducted for the waste stream
disposed and recycled in the calendar year 2011 and reported to
each county and regional solid waste authority, the Legislature and
the Governor by June 30, 2012.
(c) In an effort to ensure accuracy, every municipality,
county or regional solid waste authority, commercial waste hauler,
commercial recycler, commercial business or institution shall
submit recycling tonnage data sorted by material type to the West
Virginia Solid Waste Management Board for the calendar year 2011.
Such data shall be reported before February 28, 2012.
(d) West Virginia Solid Waste Management Board shall initiate
a one-time award program to recognize and honor one municipality,
one county or regional solid waste authority, one commercial waste
hauler, one commercial recycler, one commercial business and one
institution with the highest recycling tonnages in their category.
(e) To aid in future recycling planning, every municipality,
county or regional solid waste authority, commercial waste hauler
and commercial recycler that collects recyclables in West Virginia
shall submit annual recycling tonnage data sorted by material type
from the previous calendar year to the West Virginia Solid Waste
Management Board before February 28 of each year beginning in 2013. The Solid Waste Management Board shall include this information in
the next West Virginia Solid Waste Management Plan.
